These Terms & Conditions apply to the hire of a Track Start Training motorcycle for use during a Track Start Training coaching or track day event. It pertains to any and all motorcycles under hire by Track Start Training.
By booking, paying for and/or accepting a Track Start Training hire motorcycle, the rider confirms they have read, understood and agree to the Track Start Training Motorcycle Hire Terms & Conditions, including that they may incur costs for damage or misuse of the hired motorcycle.
1. Motorcycle hire
Track Start Training (TST) offers motorcycles for hire to eligible riders participating in Track Start Training events.
The motorcycle is provided solely for use at the nominated track, during the nominated event and for the purpose for which the hire has been agreed.
The motorcycle hire fee begins at $200 per motorcycle per event/day, unless otherwise stated at the time of booking (such as in the event of hiring more expensive vehicles).
The hire fee does not include the cost of the track day, coaching, rider licence, track fees, riding gear, fuel or any other event-related costs unless specifically stated in the booking.
No security deposit is required at the time of hire.
The absence of a security deposit does not limit the rider's responsibility for damage, loss or other costs arising under these Terms & Conditions.
2. Eligibility to hire
To hire a Track Start Training motorcycle, the rider must:
-
meet the minimum age and licensing requirements applicable to the event and motorcycle;
-
hold any licence, permit or accreditation required by the track, event organiser or relevant motorcycling authority;
-
have the appropriate riding experience for the motorcycle being hired;
-
comply with all Track Start Training, track and event rules;
-
complete any required waiver, indemnity, hire agreement or rider declaration; and
-
provide accurate contact and identification information when requested.
Track Start Training may refuse or cancel a hire where it reasonably considers that a rider does not have the experience, licence, equipment, fitness or ability required to safely operate the motorcycle - or, for any other reason TST and its coaches or officials deems of their own discretion.
3. Condition of the motorcycle
The motorcycle will be inspected by Track Start Training before it is provided to the rider.
Where practical, the condition of the motorcycle will be recorded through photographs, video or an inspection checklist before the rider takes possession of it.
The rider must inspect the motorcycle before riding and immediately notify Track Start Training of any existing damage, mechanical issue or other concern that has not already been identified.
By accepting the motorcycle, the rider acknowledges that, to the best of their knowledge, the motorcycle is in an acceptable condition for the intended use.
4. Rider responsibility
The rider is responsible for the motorcycle from the time it is handed over until it is returned to Track Start Training.
The rider must:
-
operate the motorcycle responsibly and within their own ability;
-
follow all instructions provided by Track Start Training, coaches, officials and track personnel;
-
comply with all applicable track rules and event requirements;
-
use appropriate safety equipment;
-
not allow another person to ride the motorcycle;
-
not lend, transfer or otherwise provide the motorcycle to another rider;
-
not modify, adjust or tamper with the motorcycle without prior approval from Track Start Training;
-
not remove, replace or alter any parts;
-
not intentionally perform stunts, burnouts or other activities outside normal track riding;
-
not ride while affected by alcohol, drugs or any substance that may impair their ability to ride safely; and
-
immediately report any crash, fall, mechanical problem or damage to Track Start Training.
5. Track use only
The motorcycle is supplied for use at the nominated track or event only.
The motorcycle must not be ridden:
-
on public roads;
-
on any other track or circuit;
-
off-road;
-
in competition or racing, unless expressly authorised by Track Start Training; or
-
outside the agreed hire period.
Any unauthorised use may result in the rider being liable for all resulting loss, damage, recovery costs and other reasonable expenses.
6. Damage to the motorcycle
Track riding involves an inherent risk of falling, crashing and damaging a motorcycle.
The rider accepts responsibility for damage to the Track Start Training motorcycle that occurs while the motorcycle is in their possession, except to the extent that the damage results from a pre-existing condition, mechanical failure not caused by the rider, or another circumstance for which the rider is not legally responsible.
This applies regardless of whether the motorcycle remains rideable following an incident.
Examples of damage may include, but are not limited to:
-
fairings and bodywork;
-
handlebars and controls;
-
levers and foot controls;
-
wheels and tyres;
-
brakes;
-
suspension;
-
engine or transmission components;
-
exhaust systems;
-
frame or subframe;
-
electrical components;
-
fuel systems;
-
radiator and cooling components;
-
engine covers;
-
rearsets;
-
screens;
-
stands;
-
crash protection; and
-
any other motorcycle component damaged during the hire period.
7. Repairable damage
Where damage is reasonably capable of being repaired, Track Start Training may arrange for the motorcycle to be assessed and repaired.
The rider will be responsible for the reasonable cost of repairing damage caused during their hire period, including parts, labour, specialist assessment and any reasonable associated costs.
Track Start Training may obtain a repair assessment or quotation from a suitably qualified motorcycle repairer or other appropriate specialist.
The rider will be provided with reasonable details of the damage and associated costs upon request.
8. Damage beyond economical or practical repair and total loss
If, following an incident, the motorcycle is assessed as being beyond economical or practical repair, or the cost of returning the motorcycle to a safe and usable condition is considered unreasonable in relation to the motorcycle's value, the rider will be responsible for the full purchase/replacement cost of the motorcycle.
This may apply where the motorcycle is:
-
declared a total loss;
-
structurally damaged;
-
damaged beyond economical repair;
-
damaged to the extent that it cannot safely or practically be returned to service; or
-
stolen, lost or otherwise unable to be returned to Track Start Training.
For the avoidance of doubt, the rider's liability in these circumstances is not limited to the $200 hire fee. If the motorcycle of hire is considered a total loss, the rider will be liable for the replacement cost of the vehicle, as specified below.
For reference, the total expected cost the rider agrees to by entering this contract for hire, to pay in the event of total loss within 7 days of write off status communication to the rider is:
CBR125: $1,000AUD
R15: $1,500AUD
R3: $4,000AUD
Where the motorcycle is assessed as repairable, Track Start Training will not require the rider to purchase the motorcycle instead of paying the reasonable repair costs.
The applicable replacement amount will be based on the reasonable cost of replacing the motorcycle with an equivalent motorcycle, taking into account the motorcycle's make, model, specification and condition at the time of the incident.
Where the motorcycle is assessed as repairable, Track Start Training will not require the rider to purchase the motorcycle instead of paying the reasonable repair costs.
9. No damage deposit
Track Start Training does not require a security or damage deposit for motorcycle hire.
This is provided as a convenience to riders and does not constitute a waiver, limitation or reduction of the rider's responsibility for damage.
Where damage occurs, Track Start Training may invoice the rider for the applicable repair, replacement or other reasonable costs in accordance with these Terms & Conditions.
The rider agrees to pay any properly incurred amount within the payment period stated on the invoice.
10. Mechanical failure
Track Start Training will take reasonable steps to ensure that hire motorcycles are maintained and suitable for their intended use.
If a mechanical failure occurs that is not caused by the rider, Track Start Training will assess the motorcycle and determine the appropriate response.
Where possible, Track Start Training may repair or replace the motorcycle, subject to motorcycle availability.
A mechanical failure does not automatically entitle the rider to a refund of the hire fee where the failure is caused by rider misuse, neglect, unauthorised modification, continued operation after a warning or failure to report an issue.
11. Crash or incident procedure
If the rider crashes, falls or is involved in an incident, they must:
-
follow all track and event emergency procedures;
-
seek medical attention where required;
-
notify Track Start Training as soon as reasonably practicable;
-
not attempt to repair or modify the motorcycle unless instructed to do so;
-
not continue riding the motorcycle if it may be unsafe; and
-
cooperate with any inspection or assessment of the motorcycle.
Track Start Training may remove a motorcycle from use following an incident where it considers this necessary for safety or assessment.
12. Rider conduct
Track Start Training reserves the right to immediately terminate a motorcycle hire where a rider:
-
rides recklessly or dangerously;
-
disregards instructions from a Track Start Training coach, official or track operator;
-
rides outside their allocated group or permitted area;
-
allows another person to ride the motorcycle;
-
rides while impaired by alcohol or drugs;
-
deliberately abuses or misuses the motorcycle;
-
tampers with the motorcycle;
-
behaves aggressively or inappropriately towards staff, coaches, officials or other participants; or
-
otherwise breaches these Terms & Conditions or applicable event rules.
Termination of the hire does not remove the rider's responsibility for damage or other amounts already incurred.
13. Riding equipment
The rider must wear all safety equipment required by the track, event organiser and Track Start Training.
This may include approved motorcycle leathers, helmet, gloves, boots and other protective equipment.
Track Start Training may refuse to allow a rider to use a hire motorcycle if the rider does not have suitable safety equipment.
14. Fuel and consumables
The rider is responsible for fuel and any consumables specifically identified as the rider's responsibility before the hire commences.
Track Start Training may specify the required fuel type and any other operating requirements for each motorcycle.
The rider must not use an incorrect fuel, fluid or other consumable in the motorcycle.
15. Modifications and adjustments
The rider must not make any modification to the motorcycle without prior approval from Track Start Training.
This includes, but is not limited to:
-
changing suspension settings beyond agreed adjustments;
-
changing gearing;
-
removing or installing components;
-
changing tyres;
-
changing brake components;
-
fitting accessories;
-
applying decals or stickers; or
-
making electrical or mechanical changes.
Any approved adjustment must be carried out by, or with the approval of, Track Start Training.
16. Cancellation and non-attendance
Motorcycle hire is linked to the rider's nominated Track Start Training event.
If the rider cancels or does not attend, the hire fee will be dealt with in accordance with Track Start Training's event cancellation policy.
If the event is cancelled by Track Start Training, the track operator or due to circumstances outside Track Start Training's reasonable control, Track Start Training will advise riders of the available options.
17. Weather and track conditions
Motorcycle track riding is affected by weather and track conditions.
The rider is responsible for making an informed decision about whether they are comfortable riding in the prevailing conditions, subject to any direction from Track Start Training, the track operator or event organiser.
Track Start Training may withdraw a motorcycle from use where it considers conditions, mechanical issues or other circumstances make continued use unsafe.
18. Personal injury and inherent risks
The rider acknowledges that motorcycle track riding is a recreational activity involving inherent and obvious risks, including the risk of serious injury or death.
The rider agrees to follow all safety instructions and track rules and to ride within their ability.
Nothing in these Terms & Conditions is intended to exclude, restrict or modify any right or remedy that cannot lawfully be excluded, restricted or modified under Australian law.
19. Australian Consumer Law
Nothing in these Terms & Conditions excludes, restricts or modifies any rights or guarantees that cannot lawfully be excluded, restricted or modified under the Australian Consumer Law or other applicable legislation.
Where a provision of these Terms & Conditions would otherwise be inconsistent with a non-excludable legal right, that legal right will prevail to the extent of the inconsistency.
20. Recovery of costs
Where the rider is liable for damage or other costs under these Terms & Conditions, Track Start Training may seek recovery of the reasonable costs incurred.
This may include, where reasonably incurred:
-
repair costs;
-
replacement parts;
-
labour;
-
specialist inspection or assessment;
-
motorcycle recovery or transport;
-
storage;
-
cleaning where required as a result of misuse or an incident;
-
reasonable administrative costs associated with assessing or recovering the motorcycle; and
-
replacement of the motorcycle where it is beyond economical or practical repair.
21. No transfer of hire
The motorcycle hire is personal to the rider named on the booking.
It cannot be transferred to another person without prior approval from Track Start Training.
The rider remains responsible for the motorcycle until it has been formally returned and accepted by Track Start Training.
22. Acceptance of these Terms & Conditions
By booking a Track Start Training hire motorcycle, signing the motorcycle hire agreement, or accepting and using the motorcycle, the rider confirms that they:
-
have read and understood these Terms & Conditions;
-
agree to comply with them;
-
understand that motorcycle track riding carries inherent risks;
-
understand that no damage deposit is required;
-
understand that they remain financially responsible for damage caused during their hire period; and
-
understand that damage beyond economical or practical repair may result in liability for the full replacement cost of the motorcycle.
